SPECIAL CONDITIONS
Temporary Sales Restriction / Owner-Occupancy Obligation:
The property must be used by the buyer (and family) for their own residence for at least 5 years. Occupation or rental by direct relatives is considered equivalent to own use.
The buyer is prohibited from selling the property within the first year. After one year, resale is allowed only with written permission from the housing corporation. The new buyer must also use the home for their own residence. This obligation expires 5 years after the initial sale by the corporation.
Anti-Speculation Clause:
In addition to the above, the buyer must pay part of the resale profit (if sold within 5 years) to the housing corporation:
Within 1 year: 100% of the profit;
Year 2: 80%;
Year 3: 60%;
Year 4: 40%;
Year 5: 20%.
Use Restriction (Qualitative Obligation):
The buyer agrees not to use the property for anything other than residential purposes. Use for business, room rental, B&B, or similar is strictly prohibited. This obligation passes to future owners.
Non-Resident Clause:
As the seller (housing corporation) has never lived in the property, a non-resident clause will be included in the purchase agreement.
Notary:
The property must be transferred via Metis Notarissen in Maastricht Airport or Hendriks & Fleuren Zuyd Notarissen in Heerlen.
Written Agreement Requirement:
A purchase agreement is only valid after being signed by both parties ("written requirement").
Suspensive Conditions Period:
Any agreed-upon resolutive conditions (e.g. financing) typically have a period of 4 to 6 weeks after the verbal agreement.
Deposit/Bank Guarantee:
A deposit or bank guarantee of 10% of the purchase price is required and must be deposited with the notary within 2 weeks after expiration of the resolutive conditions.
Technical Inspection:
The buyer has the right to commission a building inspection or consult other advisors at their own expense to assess the property's condition.
