Owner-occupancy obligation/anti-speculation clause
1. The buyer must occupy the home himself. The buyer may therefore not rent out this home or otherwise allow other persons or companies to use it. This owner-occupancy obligation ends 2 years after the transfer of the home to the buyer. If the buyer sells the home within this period and delivers it to someone else, he must pass on this owner-occupancy obligation to the new buyer/owner. This obligation is therefore included as a chain clause in the deed of delivery.
If the buyer or his legal successor (new buyer/owner) fails to comply with these obligations, he owes the seller an immediately due fine of €50,000.
2. The buyer may sell the home to another party, but must pay the seller 100% of the profit from the date of notarial delivery up to and including 2 years thereafter. In this article, profit is understood to mean the difference between the purchase price of the property sold under this agreement and the (sales) price for which the buyer alienates the home in the future, or the value in economic traffic at that time of the home if this value is higher, from which the value attributable to the improvements or renovations made by and on behalf of the buyer is then deducted.
The value of the improvements or renovations made by and on behalf of the buyer is determined in mutual consultation between the seller and the buyer, and if they cannot reach an agreement in mutual consultation, by an independent appraiser. If necessary, the seller will appoint a valuer to determine the value of the improvements and renovations made by the buyer himself. The costs for the valuer are for the account of the buyer.
